The test runner when setting up the tests basically skips everything booting into a live session. After switch to syslinux 6, they no longer seem to pass correct boot time options and thus do not boot into "maybe-ubiquity mode" (aka try or install ubiquity) and instead do the default option of simply booting into the live session.
